Many Florida medical professionals do not understand the subtle differences in products with respect to (illegal) payer clauses and credentialing in managed care contracts.  It is absolutely critical to get all documentation reviewed before signing a contract. Florida PIP Reform Compliance

A new law was passed in 2013 addressing benefits paid to drivers, which has significantly affected chiropractors and other healthcare pros and providers. The basic crux of the new statute is that if the new patient is not declared to have an emergency medical condition, he or she will not have the full $10,000 previously available under Florida personal injury protection (PIP) law, but will only have $2,500 to reimburse to healthcare providers that treat these patients. It has also spurred a number of interesting potential interesting transactions and growth in various sectors of the healthcare community.

This issue has posed immensely complex credentialing issues. Many chiropractors will have to be credentialed and clinics will have to determine what they are credentialed to do. Additionally, it will be necessary for many organizations to determine the employment status of MDs, how services are to be provided under the Florida Healthcare Clinic Act and whether physical therapy will be provided.

In certain cases, Medicare and private insurance carriers will not allow for physical therapy by certain doctors, but there can be exceptions. The process is immensely complex and if not properly addressed can result in huge requests for overpayment refunds by various carriers. The federal Stark Law applies to physicians when they make referrals (to an entity for a designated health service) for Medicare and Medicaid patients. This often needs to be analyzed when there is a financial agreement, including:

On the state level, regulations are similar but only involve investment or ownership interest. The Florida law applies to all referrals — workers' compensation, PIP, private insurance, self-pay and self-referrals. While the Florida law applies to health services, it has a catch-all provision. It is often overlooked in transactions when people are going into ownership relationships with physicians. What's unique is that both are per se— they do not require intent to violate. As such, all management agreements and management services agreements that involve referrals require review by counsel in order to protect against exposure.

  • Pioneer ACO Model

  • Permanent participants and potential credentialing requirements and if it is a shared savings model

  • Structure, composition and ownership of the governing body
  • Clinical requirements — does it have a formalized checklist or credentialing process?
  • Whether physicians can join another ACO

Florida Attorneys For Incident To Billing And Compliant Use Of Non-physician Practitioners

With the current economic landscape, there is more consolidation within the healthcare industry and physicians are forced to do more with less.  Many doctors are employing the use of physician assistants and nurse practitioners to streamline processes. Many private insurers and Medicare and Medicaid allow this and allow for billing of services.

While nurse practitioners and assistants can get their own billing numbers, they pay at a lower reimbursement rate.  This is an area of billing under Medicare and now under Florida Medicaid that allows for the ancillary provider (the non-physician practitioner) to provide the service and bill at the physician's level of the fee schedule.  This can obviously be very lucrative and allow doctors to see more and more patients on a regular basis.

That said, this can present significant confusion as many doctors and billing staff do not often know how to bill or track correctly.  They think that because a nurse practitioner can practice under indirect supervision that they can then bill.  In actuality, it must be direct supervision.

This opens up significant problems with reimbursement levels. Physicians must be aware of the scope of practice that a nurse practitioner or physician assistant can apply.  This raises questions like:

  • Can they prescribe?
  • What services can be billed?
  • What is incident to services?
  • What level of supervision is required?
  • Do they have to be employed by the practice?
  • Must they be licensed in Florida?
